1. Agreement to Terms
By accessing or using Delvixo's services, website, or client portal, you agree to be bound by these Terms of Service. If you do not agree, do not use our services. These terms constitute a legally binding agreement between you and Delvixo.
2. Services
Delvixo is a full-service digital agency providing managed services including website design and development, website maintenance, SEO, reputation consulting, social media management, ads management, backend systems setup, and payment automation. Specific deliverables are outlined in your selected service configuration.
3. Billing and Payment
Services are billed on a monthly basis. Payment is due at the beginning of each billing cycle. Packages are month-to-month with no long-term contracts, except services with a stated minimum term (currently Reputation Management done-for-you, which carries a 6-month minimum). Outside any stated minimum term, you may cancel at any time with no cancellation fees.
4. Cancellation
You may cancel your subscription at any time by contacting us at info@delvixo.com or through your client dashboard. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months of service.
5. Client Responsibilities
You agree to: provide accurate business information for service setup; respond to requests for approvals in a timely manner; use generated leads and data in compliance with applicable laws including CAN-SPAM and GDPR; not resell or redistribute data provided through our services.
6. Data and Lead Accuracy
While we strive for high quality in our website, SEO, reputation, and marketing services, we do not guarantee specific rankings, traffic, or results. Outcomes may vary based on industry, market conditions, and other factors outside our control.
7. Intellectual Property
All content, tools, dashboards, reports, and systems developed by Delvixo remain our intellectual property. You retain ownership of your business data and any content you provide to us. Lead data delivered to you may be used for your business purposes.
8. Limitation of Liability
Delvixo shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid by you in the three months preceding the claim.
9. Modifications
We reserve the right to modify these terms at any time. Material changes will be communicated via email or through the client dashboard. Continued use of our services after changes constitutes acceptance of the new terms.
