1. Agreement to Terms

By accessing or using Delvixo's services, website, or client portal, you agree to be bound by these Terms of Service. If you do not agree, do not use our services. These terms constitute a legally binding agreement between you and Delvixo.

2. Services

Delvixo provides managed B2B growth services including website design and development, website maintenance, lead generation, cold email outreach, reputation management, SEO consulting, competitor intelligence, backend systems setup, and payment automation. Specific deliverables are outlined in your selected service configuration. All work is custom-scoped to your business.

3. Billing and Payment

Recurring services are billed on a monthly basis. Payment is due at the beginning of each billing cycle. All recurring packages are month-to-month with no long-term contracts. You may cancel at any time with no cancellation fees. One-time services (such as website design and build, payment flow setup, and other project-based work) are billed in full at the start of the engagement and are non-refundable once work begins.

4. No Refunds: Custom Work Policy

All Delvixo services are custom-built for your specific business. Lead lists are researched against your unique ICP, cold email sequences are written by hand for your offer, websites are designed and developed to your brand and content, SEO audits and action plans are produced specifically for your domain, and backend systems are configured for your operational workflow. Because the work is custom and cannot be resold or reused for another client, we do not offer refunds.

This applies to:

• One-time projects (website design, payment flow setup, custom backend systems): non-refundable once work begins.
• Monthly recurring services: cancel any time, no further charges; no refunds for the current billing period or any past period already invoiced.
• Add-on services: same policy as the parent service tier.

5. Cancellation

You may cancel any recurring subscription at any time by contacting us at info@delvixo.com or through your client dashboard. Cancellation takes effect at the end of your current billing period and you retain access through that date. No refunds are provided for partial or full months of service already paid for.

6. Client Responsibilities

You agree to: provide accurate business information for service setup; respond to requests for approvals in a timely manner; use generated leads and data in compliance with applicable laws including CAN-SPAM, GDPR, CCPA, and state-specific regulations; not resell or redistribute data provided through our services; not use Delvixo services for industries we explicitly do not support (adult content, gambling without proper licensing, scam or fraud-related offers).

7. Data and Lead Accuracy

While we strive for high accuracy in our lead generation and data services, we do not guarantee 100% accuracy of contact information, email deliverability, response rates, meeting counts, or sales outcomes. Results may vary based on industry, market conditions, your offer fit, your sales team execution, and other factors outside our control. We guarantee execution standards (researched leads, hand-written outreach, verified emails, healthy deliverability) but not specific business outcomes.

8. Intellectual Property

All content, tools, dashboards, reports, internal templates, and systems developed by Delvixo remain our intellectual property. You retain ownership of your business data and any content you provide to us. Lead data delivered to you may be used for your business purposes. Websites we build for you are owned by you upon final payment of the project fee.

9. Limitation of Liability

Delvixo shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid by you in the three months preceding the claim.

10. Modifications

We reserve the right to modify these terms at any time. Material changes will be communicated via email or through the client dashboard. Continued use of our services after changes constitutes acceptance of the new terms.
